1. Nature of the Organization
RAMA is a social club facilitating the exchange of information between people. RAMA events involve the sharing of Fungi related topics and includes hands-on events in the field as well as other events that include but are not limited to guest mycology speakers, special research projects, microscope workshops, and myco crafting and cultivation demonstrations.
2. User Registration and Information
Member shall fill in the correct information in this Membership Form. Member shall be responsible for updating information changes with the club Treasurer. Member registration is extended to each member of a household that signs this Agreement.
RAMA Content includes photos, messages, and other materials communicated at in person events, on forums, groups, or other locations by members of RAMA. Members grant RAMA the nonexclusive right to post, display or copy Content created in connection with the operation of RAMA business. Member also authorizes RAMA to disclose their personal data when the Member includes such in the Content.
If the Member has a dispute with one or more other Members, the Member shall release RAMA (and it’s officers, directors, agents, subsidiaries, joint venture and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
RAMA shall not sell or rent Members’ personal information to third parties. RAMA shall store and process Member information on computers located in the United States that are protected by physical as well as technological security devices. However, RAMA shall be permitted to access and modify Member information.
Member shall indemnify and hold RAMA (and it’s officers, directors, agents, subsidiaries, joint venture and employees) harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of Members breach of this Agreement, or Members violation of any law or the rights of a third party.
7. No Agency
No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.
8. Terminating Membership
Member may choose to retire from membership and be removed from the membership rolls. Terms regarding the status of Content shall remain applicable when the Member chooses to terminate the membership. RAMA may terminate a Members membership for violation of the Agreement or the organization’s bylaws.
9. Governing Law
This agreement shall be construed under and governed in accordance with the laws of the State of New York.
Any dispute arising under this Agreement shall be resolved under the commercial arbitration rules of the American Arbitration Association.
11. Limitation of Liability and Acknowledgement of Participant Responsibility
Member shall not hold RAMA responsible for other Member Content, actions, or inactions.
Member acknowledges that the consumption of wild fungi can be dangerous, and proper identification is difficult. Member agrees that RAMA does not provide sufficient education to serve as the sole source of information regarding the edibility of any fungi or flora, and assumes sole responsibility for their decision to consume any wild specimens. Member acknowledges that forays and field trips can include walking distances and over terrain that may sometimes prove difficult and may require coming prepared for the destination. Member agrees to follow all guidance from foray and field trip leaders as well as the staff and management of the properties RAMA visits regarding collections and surveys during RAMA events.
